Crown seeks jail for accused in fatal hit-and-run

Hours after drinking in hardcore rapper Lil Wayne's gig at Scotiabank Place, Layla Aman was on the road, heading for Bronson Ave.

Meanwhile, Daniel Miller had taken down about half a dozen beers at a buddy's house, at least according to his friend, who was walking Miller home.

On Aug. 17, just after 3 a.m., their paths crossed -- and Miller was dying by the roadside.

Aman, 24, had struck him with her Nissan as he crossed the road, talking to his friend.

The impact sent Miller, 22, flipping twice through the air, his boots flying off, before he landed 15 metres away, his skull and legs fractured.

At 6:12 a.m. he was dead.

Aman has pleaded guilty to failing to remain at the scene.

On Monday, lawyers argued her fate.

Crown prosecutor Jason Neubauer wants nine to 12 months jail and a two-year driving ban.

"You stop. And you do what you can," he said. "It flows out of basic humanity."

Defence lawyer Norm Boxall reminded the court that Aman was not speeding when she struck Miller -- in fact she was doing 41 to 50 km/h in a 60 km/h zone.

The facts say she tried to avoid hitting Miller, who an independent witness said was tottering and "looking quite drunk" as Miller spoke to his friend from the middle of the road.

"It was a tragic accident," said Boxall, who argued for a 90-day sentence that could be served on weekends.

Aman eventually turned herself in to police, though only after cops found the damaged car and spoke to her father and her boyfriend.

"The careless disregard for my brother Daniel's life is incomprehensible," sister Stephanie Hartman said in a victim impact statement. "I will never understand how anyone could leave another person to die.

Aman will be sentenced Aug. 10.
